Vehicle Accidents:


The insurance company of a person who negligently operates a motor vehicle may be required to pay damages to the injured victims. "Vehicle accidents" include car accidents, boating accidents, motorcycle accidents, and semi-tractor/trailer accidents, to name a few.


Sometimes the at-fault driver is uninsured, or has insurance in an amount too low to fully compensate the victim. In those instances, the victim may have a claim for "uninsured motorist coverage" or "under-insured motorist coverage" under the provisions of his or her own insurance policy.

Wrongful Death:


The law provides for compensation to the family of a person killed by the carelessness or fault of another person or entity. The deceased's family may be entitled to payment for the loss of the deceased person's society, companionship, and comfort, and for the financial support the deceased person would have provided had he or she not been killed, as well as payment for medical and funeral expenses.

Dangerous/Defective Products:


The law imposes strict liability upon a manufacturer, distributor, or seller of a dangerous product that harms others. Liability may be found upon theories of strict product liability, negligence, or breach of warranty.

Medical/Legal Malpractice:


Medical malpractice is the failure of a health care provider to use reasonable diligence and expertise in caring for a patient. If a physician was careless, lacked proper skills, or failed to follow proper procedures, the physician may be held liable for negligence. Hospitals may also be held liable for the negligence of their employees, including staff nurses and technicians.


Legal malpractice is the failure of an attorney to use reasonable diligence and expertise in caring for a client. If the attorney missed a deadline, failed to properly investigate a case, failed to understand new laws, or was careless in representing a client, then the attorney may be held liable for such negligence.


All professionals bear similar responsibilities and have similar liabilities.

Insurance Claims:


Nearly all injury claims we accept are covered by insurance, either motor vehicle insurance, homeowner's insurance, business insurance, or professional insurance. "Insurance claim" and "personally injury claim" usually mean the same thing.

Premises Liability:


The owner of a residence, land, or place of business has a duty to exercise reasonable care to protect individuals who are invited upon the premises from unreasonably dangerous conditions. Failure to perform this duty may result in the owner being held liable for damages suffered by those who are injured as a result of such neglect.


Landlords have a special duty under the "Landlord-Tenant Act" to provide habitable housing, including stairs and railings that are properly maintained. Landlords are strictly liable for injuries that are caused by a breach of this duty.

Dog Bites:


Vicious dog bites leave scars and have lasting emotional effects. A dog bite victim may be entitled to compensation from the dog's owner if it can be shown that the owner knew or should have known that the dog was dangerous.

Sexual Abuse:


If you have been the victim of rape or sexual abuse, you have a claim against the person who committed the act, and may also have a claim against the organization or business that allowed the person access to you, especially if you were a child and the abuse was committed by a person you trusted or feared because of the organization to which he or she belonged.

Elder Abuse:


Elderly and disabled people are sometimes committed to the custody and care of foster homes, nursing homes, and residential care facilities. Sadly, some elderly people are neglected and even abused in such facilities. If that has happened to a family member, he or she may have a claim for elder abuse.
